1. Platform Purpose

Behaviour Trackr is a secure digital record management platform designed to support structured recording, organisation, and reporting of information relating to:

• behaviours
• supports
• therapy sessions
• education participation
• daily observations
• incidents
• routines
• medication notes
• health observations
• invoices
• attendance records
• travel records
• support delivery records

Behaviour Trackr is an administrative and evidence-support tool only.

It does not provide:

• medical advice
• clinical decision-making
• therapeutic direction
• behavioural treatment planning
• crisis response
• safeguarding supervision
• emergency intervention

The platform must not be relied upon as a substitute for regulated professional advice.

2. Scope of Use Across Sectors

Behaviour Trackr may be used by:

• individuals
• parents and guardians
• self-managed participants
• NDIS participants
• support workers
• disability providers
• therapists
• allied health professionals
• schools
• educators
• early intervention providers
• aged care users
• authorised representatives

Use within any regulated environment remains the responsibility of the subscribing user or organisation.

Behaviour Trackr does not certify compliance with:

• NDIS Practice Standards
• school record obligations
• therapy record regulations
• aged care documentation standards
• health record legislation

Users remain solely responsible for ensuring compliance within their own profession, service, or organisation.

3. User Authority and Legal Responsibility

Users warrant that they have lawful authority to:

• enter information
• upload records
• share documents
• invite additional users
• manage participant information

Where records relate to another person, the user confirms they have legal authority, consent, guardianship, employment authority, or service authority to do so.

Behaviour Trackr accepts no responsibility for unauthorised use of another person's information.

4. Accuracy of Records

All entries, reports, notes, observations, and uploads remain the responsibility of the user entering the information.

Behaviour Trackr does not verify:

• factual accuracy
• completeness
• timing of records
• interpretation of incidents
• behavioural descriptions
• therapy notes
• medication references

Reports generated by the platform are entirely dependent on the quality and accuracy of user-entered content.

Any third party relying on exported records does so at their own risk.

5. Clinical and Funding Non-Reliance

Behaviour Trackr may assist with evidence gathering, however it does not guarantee:

• NDIS funding approval
• change of circumstances approval
• school funding outcomes
• therapy recommendations
• legal outcomes
• behaviour support approval
• clinical acceptance

No clinician, practitioner, school, agency, assessor, plan manager, support coordinator, or funding body is required to accept platform-generated records.

6. No Emergency Monitoring

Behaviour Trackr is not monitored in real time.

It must never be used as an emergency communication tool.

Users must not rely on Behaviour Trackr for:

• crisis escalation
• urgent behavioural incidents
• self-harm response
• safeguarding alerts
• medical emergencies
• medication emergencies
• welfare concerns requiring immediate intervention

Emergency services, clinical teams, schools, or direct support services must be contacted where urgent response is required.

7. Privacy and Sensitive Information

Behaviour Trackr may contain highly sensitive information including:

• disability records
• therapy notes
• behavioural incidents
• medication notes
• seizure records
• health observations
• education records
• family records
• daily care records

Users must ensure all uploaded content is lawful and appropriate.

Users must not upload:

• unlawful content
• defamatory content
• offensive content
• records without lawful authority

8. Security and Information Protection

Behaviour Trackr applies information security measures aligned with recognised ISO27001 information security principles.

This includes:

• encrypted handling of stored data
• access control permissions
• account-level role management
• secure user authentication
• controlled internal access

While reasonable security measures are applied, no online system can guarantee absolute security.

Behaviour Trackr excludes liability for cyber events beyond reasonable control.

9. Subscription Terms

• Subscriptions are billed in advance.
• Users are responsible for selecting the correct plan.
• Subscriptions automatically renew unless cancelled before the next billing cycle.
• Access may be suspended where payment fails.
• We reserve the right to amend pricing with reasonable notice prior to renewal.

10. Refund Policy

We do not provide refunds for:

• change of mind
• partial usage
• unused subscriptions
• incorrect plan selection
• failure to use available features
• misunderstanding of platform suitability
• third-party outages
• internet interruptions
• user technical limitations
• delays caused by external providers

Refunds will only be considered where required under Australian Consumer Law.

11. Platform Availability

Behaviour Trackr aims for continuous availability but does not guarantee uninterrupted access.

Access may be affected by:

• maintenance
• upgrades
• technical interruptions
• third-party outages
• cyber incidents
• force majeure events

Features may be modified, improved, replaced, or removed without prior notice.

12. Limitation of Liability

To the fullest extent permitted by law, Behaviour Trackr excludes liability for:

• indirect loss
• consequential loss
• funding refusal
• loss of income
• service interruption
• missed incidents
• delayed responses
• incorrect records
• report interpretation
• legal claims arising from user-entered content
• reliance by third parties

Where liability cannot be excluded, maximum liability is limited to fees paid by the user within the previous 1 month.

13. NDIS, School, Therapy and Provider Use

Behaviour Trackr does not assume legal responsibility for provider compliance.

Users remain responsible for:

• incident reporting obligations
• mandatory reporting obligations
• restrictive practice obligations
• safeguarding obligations
• school documentation obligations
• therapy file obligations
• consent obligations

The platform is a support tool only.

14. Intellectual Property

All rights remain owned by Behaviour Trackr, including:

• platform design
• structure
• reporting workflows
• wording
• templates
• interface systems

Users must not:

• copy
• reproduce
• commercially imitate
• reverse engineer

15. Account Suspension or Termination

We may suspend or terminate access where:

• misuse occurs
• abusive conduct occurs
• unlawful records are uploaded
• payment defaults occur
• data misuse occurs

16. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
